Charlotte regularly prepares wills for clients. This includes straightforward wills and wills with trusts, where there are asset protection concerns. She talks to clients in detail about their circumstances to establish the type of will they need.
She has helped families with disabled children prepare wills where their assets are to be left into a vulnerable person's trust. These families are often referred to her directly from Mencap. Families often worry that their disabled children would not be able to manage an inheritance and could become vulnerable to unscrupulous third parties. Using a trust in these circumstances can reduce those risks.
She prepares both property and financial affairs and health and welfare Lasting Powers of Attorney, acts as certificate provider where appropriate, and registers them with the Office of the Public Guardian.
When someone has passed away, she applies for Grants of Probate and administers estates, including estates that are subject to inheritance tax, making sure that all available allowances and exemptions are claimed. She also helps clients apply to the Court of Protection to be appointed as deputies when a loved one has lost mental capacity.
She prepares declarations of trust when people are buying property in unequal shares and the agreement needs to be formalised. This can help protect the client's financial contributions in the event of disputes that could arise in the future.
