Work included title due diligence, deeds of easement for off-site drainage, negotiating and varying Section 106 obligations, preparing a deed of easement for a biomass heat supply to affordable units, and setting up Help to Buy arrangements. Delivered the full plot-sale pack suite and estate management structure for shared parking areas, negotiated Section 50 agreements for services crossing the public highway, and completed conditional acquisitions for phases 3 and 4 with deal values of £2.2m and £4.15m.
Acted on the acquisition of a local authority development site for £3m+ under a development agreement with full planning permission for 298 units. The scheme comprised 150 affordable rented plots for a registered provider and 148 open market homes, including 97 shared ownership units. Completed the onward sale of the 97 units to the RP for a £22m package under a Golden Brick structure with overage. Managed land sale and forward funding development agreements, contaminated land risk, utilities and servicing, Section 106 financial contributions, and the adoption of estate roads and sewers, plus delivery of a show home.
Advised a national residential developer on a £14m acquisition conditional on planning for not less than 200 dwellings. Resolved complex due diligence issues, including a restrictive covenant limiting use to agriculture, overhead electricity apparatus, potential contaminated land liability, historic coal workings, and an active planning enforcement notice. Strategy included indemnity solutions, statutory consents, coal mining risk assessment and remediation, and a planning pathway that preserved programme and value.

The structure allows the promoter, following the grant of residential planning permission, to elect either to purchase each site or to dispose to a third-party housebuilder.
