Wills & probate myth 13 – I can make a lasting power of attorney (LPA) at any time.

You can only make your LPA if you have sound mental capacity to do so. A certificate has to be provided to confirm the state of your mental capacity at the time you sign the LPA. This also confirms that you understand what the document is, what it does, who you are appointing and that you are not under any undue influence to make the LPA.
