Certificates of lawful development

A certificate of lawful development proves a development has been built lawfully on the land it occupies.

If planning permission was obtained prior to construction there is no such requirement for a lawful development certificate.

It is highly advisable to apply for a certificate of lawfulness:

  • when you wish to sell a property where no planning permission was granted
  • to assure potential buyers the property can remain in its current state
  • to guarantee no enforcement action can be taken by your local authority, such as stopping you using the property for a purpose it does not have permission for
