Planning problems can result in criminal prosecutions either for breach of an enforcement notice or a breach of condition notice. These cases are never straight forward and if you are faced with a prosecution or enforcement notice then you should contact us immediately.

One example of a recent case was where a prosecution in relation to a breach of condition notice was defeated because it was possible to demonstrate that the planning permission had never been implemented and therefore could not have been breached.
