Environmental and Waste Law

We advise public bodies and companies on a number of environmental issues including waste, water, contaminated land, air quality, nuisance, planning and sustainable development.

Staffordshire based environmental lawyer David Anderton has been involved in dealing with waste law and water law for over 40 years. He served as a non-executive director of a public company engaged in waste management for over 20 years and gave lectures on a trade association waste management course for many years. David has been involved in many of the significant cases which have shaped the law during this period.

David is joined by Jacob Rickett who previously worked in-house at the Environment Agency and has worked for a number of different regulators and companies in private practice working on enforcement and prosecution cases across the environmental, wildlife, fisheries and planning regimes. Environmental enforcement and prosecution cases include waste, pollution, statutory nuisance (noise and odour cases), environmental permitting issues (including Part A and B installations), and water and wildlife offences.

Our experience includes:

  • Advising on environmental policy and law.
  • Advising on all aspects of environmental law including:
    • Breaches of licence/permit/exemption conditions
    • contaminated land;
    • emissions to air;
    • noise, dust, odour and other nuisance issues, including enforcement and abatement notices;
    • marine and fisheries regulation;
    • nature conservation;
    • tree preservation orders;
    • waste, including: determinations; unlawful deposits; licence conditions, suspensions and revocations; and transfrontier shipment of waste;
    • water pollution, abstraction and anti pollution works notices.
  • Prosecuting and defending environmental criminal court proceedings’
  • Providing representation in civil proceedings.

We have  also helped many companies is successful applications for planning permission and permits for landfill sites and waste installations..

We act for regulators bringing prosecutions and also support businesses facing prosecutions.  Prosecutions which have been handled in recent years include:

  • breaches of licence/permit/exemption conditions
  • deposits of waste without a permit or exemption
  • transfrontier shipments of waste
  • pollution of watercourses
  • abstraction of water;
  • breaches of tree protection orders
  • abatement of nuisances.
